Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the website, mobile application, and services provided by Harvest Mutual Fund Distributors (Private) Limited (“Harvest MFD”, “Harvest”, “Company”, “we”, “our”, or “us”). By accessing or using the Harvest platform (the “Platform”), you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you should not use the Platform.
Harvest MFD operates as a digital platform that facilitates investments in mutual funds offered by Asset Management Companies (“AMCs”). Harvest MFD acts as a mutual fund distributor and does not directly manage, operate, or guarantee the performance of any mutual fund products available on the Platform.
Eligibility
The Platform is intended for individuals who are legally eligible to enter into binding agreements and invest in financial instruments under applicable laws. By using the Platform, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into financial transactions.
Users may be required to complete identity verification and regulatory compliance procedures including Know Your Customer (KYC) and Anti-Money Laundering (AML) verification before being permitted to make investments.
Account Registration
In order to use certain services on the Platform, users may be required to create an account by providing accurate and complete information. You agree that all information provided during registration and account usage will be true, current, and accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Harvest MFD shall not be liable for any losses arising from unauthorized access to your account resulting from your failure to safeguard login information.
Harvest MFD reserves the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or appear to be involved in suspicious or fraudulent activity.
Nature of Services
Harvest MFD provides a technology platform that enables users to access and invest in mutual funds offered by various Asset Management Companies. Harvest MFD does not provide guarantees of returns, capital protection, or investment performance.
All investment decisions are made solely by the user. The Company does not provide personalized financial advice unless explicitly stated and authorized under applicable regulations.
The mutual funds available through the Platform are managed by independent Asset Management Companies, and all investment transactions are processed in accordance with their policies, procedures, and regulatory guidelines.
Investment Risks
Mutual fund investments are subject to market risks and fluctuations in net asset value (NAV). Past performance of any fund does not guarantee future performance. By investing through the Platform, users acknowledge that the value of investments may increase or decrease depending on market conditions.
Harvest MFD shall not be responsible for any financial losses arising from market movements, economic conditions, fund performance, or investor decisions.
Transaction Processing
Investment transactions submitted through the Platform are processed according to the cut-off times and pricing rules determined by the relevant Asset Management Companies and applicable regulations.
Transactions submitted after the applicable cut-off time may be processed on the next business day and may be executed at the next available Net Asset Value (NAV). Harvest MFD does not control the NAV calculation process and does not guarantee transaction execution timelines beyond what is defined by AMCs.
Intellectual Property
All content available on the Platform, including text, graphics, logos, design elements, software, and documentation, is the intellectual property of Harvest MFD or its licensors and is protected by applicable intellectual property laws.
Users may not reproduce, distribute, modify, or exploit any content from the Platform without prior written permission from Harvest MFD.
Limitation of Liability
To the maximum extent permitted by law, Harvest MFD shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the Platform, including but not limited to investment losses, technical disruptions, delays in transaction processing, or reliance on information provided through the Platform.
The Platform is provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied.
Modifications to Services
Harvest MFD reserves the right to modify, suspend, or discontinue any part of the Platform or services at any time without prior notice where necessary for operational, regulatory, or technical reasons.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising from these Terms shall be subject to the jurisdiction of courts located in Pakistan.
